Terms of Service
Last updated October 25, 2026
These Terms of Service ("Terms") are a binding agreement between you and SPY 0DTE Lab ("we", "us", "our") and govern your use of this website, our Discord alerts, our playbooks and any related content (together, the "Service"). By using the Service or buying any product, you agree to these Terms, our Privacy Policy and our Risk Disclosure. If you do not agree, do not use the Service.
Please read Section 19 carefully. It requires disputes to be resolved by individual binding arbitration and waives class actions and jury trials, unless you opt out.
1. Eligibility
You must be at least 18 years old and able to form a binding contract. You may not use the Service if you are barred from doing so by law, if you are located in, or a resident of, a country or region subject to comprehensive U.S. sanctions, or if you are on any U.S. government restricted-party list. The Service is designed for users in the United States. If you use it from elsewhere, you are responsible for complying with your local laws, and we may refuse or end access in any jurisdiction where offering the Service would require a license or registration we do not hold.
2. What the Service is
The Service publishes general, impersonal information about automated SPY options strategies: a public record of every closed trade they make, alerts for the Iron Condor strategy posted to a read-only Discord channel at the same time and in the same words for every subscriber, recaps, and educational materials such as playbooks. The strategies currently trade a paper (simulated) account. We may change, suspend or discontinue any part of the Service, including the strategy's rules, at any time.
3. Not investment advice; no adviser relationship
We are not a registered investment adviser, broker-dealer, commodity trading advisor or financial planner. Nothing in the Service is investment, financial, legal, tax or accounting advice, a recommendation that any security or strategy is suitable for you, or an offer or solicitation to buy or sell any security. The Service is a bona fide publication of general and regular circulation: it does not consider your objectives, financial situation, experience or risk tolerance. We do not give individual advice, answer questions about your account, positions or position size, manage money, or place trades for anyone. No fiduciary or advisory relationship is created by your use of the Service. You are solely responsible for your investment decisions and their results; consult a licensed professional about your situation.
4. Performance information
Results we show are simulated unless expressly labeled as live, real-money results, and are subject to the limitations described in the Risk Disclosure. Results are shown in account dollars at the engine's own position size after estimated fees, and your results will differ. We show every trade, wins and losses, and do not promise or guarantee any profit or any protection from loss.
5. Your responsibilities
You are responsible for your brokerage account and its options approvals, for confirming every order before you place it, for any trade you choose to make, and for the taxes on your results. If you automate trading based on our alerts, you do so entirely at your own risk; we do not support, review or warrant any automation.
6. Purchases, subscriptions and automatic renewal
Products are sold through Whop, which processes payments and manages subscriptions under its own terms. Subscriptions renew automatically at the end of each billing period at the price shown at checkout, taxes included, until you cancel. You can cancel at any time in your Whop account; cancellation takes effect at the end of the current paid period and you keep access until then. We will notify you in advance of any price change, which applies from your next renewal. Prices are in U.S. dollars.
7. Refunds
Except where the law requires otherwise or as stated on the checkout page, subscription fees are non-refundable once a billing period starts, and digital products such as playbooks are non-refundable once delivered or downloaded. If you believe you were charged in error, contact us first so we can fix it. Filing a chargeback for a charge you authorized may result in loss of access.
8. License and restrictions
All content in the Service, including alerts, the record, playbooks, text, graphics and software, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use it for your own non-commercial purposes while you have access. You may not: share, resell, forward, republish or redistribute alerts or playbooks (including by screenshots, copying or relaying to other groups or channels); share your access or account; scrape, crawl or extract data from the Service by automated means; reverse engineer the Service; use the Service to build a competing product; or remove any notices.
9. Community conduct
In any community space we provide, do not harass others, post unlawful content, promote other services or offer investment advice or account management to other members, impersonate anyone, or attempt to manipulate any market. We may remove content and suspend or end access for any violation.
10. Third-party services
The Service relies on third parties such as Whop, Discord, hosting providers, market data providers and brokerages. Their services are governed by their own terms and privacy policies, and we are not responsible for their availability, acts or omissions.
11. Availability and accuracy
We try to keep the Service accurate and available, but alerts and data can be delayed, interrupted, incomplete or wrong, including because of data feed, broker, network, Discord or software failures. We do not guarantee that any alert will be delivered, or delivered on time.
12. Feedback
If you send us suggestions or feedback, we may use them without any obligation to you.
13. Termination
You may stop using the Service at any time. We may suspend or end your access at any time if you breach these Terms, if required by law, or if we discontinue the Service. If we end a paid subscription without cause, we will refund the unused portion of the current period. Sections 3, 4 and 7 through 22 survive termination.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, TIMELINESS AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY TRADING OR INVESTMENT LOSSES, LOST PROFITS, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including for fraud or willful misconduct.
16. Indemnification
You agree to indemnify and hold harmless SPY 0DTE Lab and its owners, employees and agents from any claims, losses and expenses (including reasonable attorneys' fees) arising from your use of the Service, your trading, your breach of these Terms or your violation of any law or third-party right.
17. Changes to these Terms
We may update these Terms. We will post the new version here with a new date and, for material changes, give subscribers reasonable notice by email or in Discord. Changes apply going forward; continuing to use the Service after they take effect means you accept them. Changes to Section 19 will not apply to a dispute already pending.
18. Governing law
These Terms are governed by the laws of the state in which we are organized and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 19, the state and federal courts located in that state have exclusive jurisdiction.
19. Dispute resolution: arbitration and class action waiver
Informal resolution. Before starting a claim, you and we agree to try to resolve the dispute informally for 30 days after written notice describing it.
Binding arbitration. Any dispute, claim or controversy arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this Section. The arbitrator may award the same individual relief a court could, but only to the individual party. Arbitration may be conducted by video or in the county where you live.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for intellectual property infringement or misuse.
Class action and jury trial waiver. You and we each waive the right to a jury trial and to participate in a class, collective or representative action. If this waiver is found unenforceable for a claim, that claim will proceed in court and the rest of this Section will still apply.
Opt-out. You may opt out of this Section within 30 days after first accepting these Terms by sending us written notice (through the support channel on our Whop store page) with your name and the email used for your purchase.
20. Electronic communications
You consent to receive notices, agreements and other communications from us electronically, including by email, in Discord and on this site, and agree that they satisfy any legal requirement that communications be in writing.
21. General
These Terms, together with the Privacy Policy and Risk Disclosure, are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. Headings are for convenience only.
22. Contact
Questions about these Terms, copyright complaints and legal notices can be sent to us through the support channel on our Whop store page.
